PROBATE

My fees for applying for a Grant of Probate to deal with the assets and liabilities and payment of inheritance tax (if any inheritance tax is payable) of a loved one who has died are based on the amount of time I spend dealing with the matter.  My fees are calculated by reference to my hourly rate and my hourly rate is £250.00 (plus VAT charged at 20%). 

The work usually includes;

- meeting with you at various stages to obtain your instructions  and advise you.
- considering all paperwork received from you which relates to the estate. 
- obtaining details of all assets belonging to the deceased and liabilities owed and corresponding with all relevant parties. 
- preparing inheritance tax forms and schedules (if necessary) and calculating the amount payable to HMRC.  
- preparing and submitting the application for Probate. 
- dealing with the administration of the estate and paying any liabilities and preparing draft estate accounts to conclude the matter. 
- reporting to you throughout and dealing with any queries you may have. 

Example 1    

Where the estate does not contain a property and there are a small number of bank accounts and investments and a small number of debts the total costs are likely to be in the region of £1,850 - £2,450 (plus VAT of 20%) and disbursements (see below). 

Example 2 

In the case of a larger estate comprising of more than one property, a large number of bank statements and investments, debts and multiple beneficiaries the total costs are likely to be in the region of £7,850 - £9,450 (plus VAT of 20%). 

Disbursements 

The usual disbursements payable will be a Probate application fee of £155 (no VAT), £1.50 for each additional official copy plus additional fees for e.g. birth and marriage certificates and copy Land Registry deeds. 


WILLS  

My fees for preparing a straightforward Will on your behalf are £250.00 (plus VAT of 20%).  

The work usually includes;

- meeting with you to discuss your requirements and obtain details of your wishes. 
- preparing a draft Will following our meeting and sending this to you for you to consider.
- meeting with you so that the Will can be signed and witnessed. 

If you are too unwell to attend a meeting at my office I can arrange a home visit at an extra cost. 


LASTING POWERS OF ATTORNEY AND COURT OF PROTECTION

My fees for preparing Lasting Powers of Attorney - there are two types - are calculated as follows; 

Preparation of Financial decisions Lasting Power of Attorney                                      (£350 plus VAT)   £420.00
Preparation of (discounted) Health and care decisions Lasting Power of Attorney  (£150 plus VAT)   £180.00

Preparation of  application to send to Office of Public Guardian to register  (£150.00 plus VAT)          £180.00 
Registration fees (payable to Office of Public Guardian)  (£82.00 x2)                                                         £164.00

The work usually includes; 

- meeting with you to discuss your requirements and obtain details of your wishes. 
- preparing draft Lasting Powers of Attorney following our meeting and sending them to you for you to consider. 
- meeting with you and the attorneys appointed so that the Lasting Powers of Attorney can be signed and witnessed. 

if you are too unwell to attend a meeting at my office I can arrange a home visit at an extra cost. 

If you need to apply to the Court of Protection for an Order appointing you as Deputy fixed costs are payable.  the amount of fixed costs currently payable (up to an including the date the Court makes the Order) is £950 plus VAT.  A court issue fee of £371  is also payable. 


GENERAL LITIGATION

My fees for advising you in relation to and if necessary representing you in Court proceedings are based on the amount of time I spend dealing with the matter. My fees are calculated by reference to my hourly rate and my hourly rate is £250.00 (plus VAT charged at 20%). 

The work usually includes; 

- meeting with you at various stages to obtain your instructions and advise you. 
- considering all paperwork received from you which relates to your case. 
- corresponding with the opposing party on your behalf. 
- interviewing witnesses and preparing witness statements and documentation. 
- issuing/responding to Court Claims issued. 
- instructing experienced Counsel to formally advise on the merits of your case and to represent you at Court hearings. 
- advising on and representing you in relation to enforcement action.  
 

FAMILY LAW
